THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Confidentiality of Health Information

Health information that Find Recovery receives and/or creates about you relating to your past, present, or future health, treatment, or payment for health care services is protected health information under the federal law known as the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R. Parts 160 and 164. The confidentiality of alcohol and drug abuse records maintained by Find Recovery is also protected by the Alcohol and Other Drug (AOD) Confidentiality Law, 42 C.F.R. Part 2. Generally, Find Recovery may not disclose to any person outside Find Recovery that you are a client, or disclose any information identifying you as an alcohol or drug abuser, or use or disclose any other protected health information except in limited circumstances as permitted by federal law. Your health information is further protected by any applicable state law that is more protective or stringent than either of these two federal laws.

2. Our Commitment to Your Privacy

Find Recovery understands that your health information is deeply personal. We are fully committed to protecting it. To provide you with quality care and to comply with state and federal legal requirements, Find Recovery creates a record of the services you receive. This Notice of Privacy Practices applies to all records of your care generated by Find Recovery. It describes how Find Recovery may use and disclose your protected health information, your rights regarding that information, and certain obligations Find Recovery has in relation to it.

Find Recovery is required by law to:

  1. Keep the health information that identifies you private
  2. Provide you with this Notice of our legal duties and privacy practices
  3. Follow the terms of the Notice currently in effect
  4. Notify you in the event of an unauthorized use or disclosure of your unsecured health information

3. Who Is Bound by This Notice

This Notice covers Find Recovery and all staff, volunteers, and personnel involved in your care. All individuals and Find Recovery as an organization will follow the terms of this Notice, and may use or disclose protected health information only as permitted or required by law. Your personal physician may maintain separate policies and their own Notice of Privacy Practices.

4. How Find Recovery May Use and Disclose Your Protected Health Information

Find Recovery collects health information about you and stores it securely. The medical record is the property of Find Recovery, but the information within it belongs to you. The following categories describe how Find Recovery may use or disclose your protected health information.

4.1 For Internal Communications, your protected health information may be shared among Find Recovery staff who need it to diagnose, treat, or coordinate your care. This includes sharing between providers, billing personnel, and quality improvement efforts. Your information will not be re-disclosed except as permitted in this Notice.

4.2 To Qualified Service Organizations and Business Associates Find Recovery may share protected health information with outside organizations that assist in providing healthcare services, such as billing companies or data processing companies. All such organizations are required by written agreement to follow the same privacy standards as Find Recovery.

4.3 In Medical Emergencies, your health information may be disclosed to medical personnel in situations where there is an immediate threat to your health and emergency intervention is required.

4.4 To Researchers Under certain circumstances, Find Recovery may use or disclose your protected health information for research purposes, provided the research project has been approved by an Institutional Review Board or equivalent privacy review board with established protocols to protect your information.

4.5 To Auditors and Evaluators Find Recovery may disclose protected health information to regulatory agencies, funders, third-party payers, and peer review organizations that monitor behavioral health programs for compliance and proper use of funds.

4.6 Pursuant to an Authorizing Court Order, Find Recovery may disclose your protected health information when required by an authorizing court order that includes specific procedures to protect your identity, as outlined in federal regulations.

4.7 Crime on Find Recovery Premises or Against Find Recovery Personnel Find Recovery may disclose a limited amount of protected health information to law enforcement if a client commits or threatens to commit a crime on Find Recovery premises or against Find Recovery personnel.

4.8 Reporting Suspected Child Abuse and Neglect Find Recovery may report suspected child abuse or neglect as mandated by state law, in a manner permitted by federal privacy and confidentiality regulations.

4.9 As Required by Law Find Recovery will disclose protected health information when required by state law and in a manner otherwise permitted by federal privacy and confidentiality regulations.

4.10 Appointment Reminders Find Recovery may contact you with appointment reminders or information about treatment alternatives and related health benefits, in a manner permitted by law.

4.11 Other Uses and Disclosures Any other use or disclosure of your protected health information not covered by this Notice will only be made with your written authorization or that of your legal representative. You may revoke that authorization at any time, except where Find Recovery has already acted in reliance on it.

5.1 Right to Inspect and Copy You have the right to inspect and receive copies of your health information maintained by Find Recovery, with certain exceptions. If your request is denied, you will be notified and provided with information on how to request a review of that denial, where applicable.

5.2 Right to Amend Your Health Information If you believe your health information is incorrect or incomplete, you may request an amendment. Find Recovery may deny the request if it does not meet the requirements set out in HIPAA regulations. You will be notified of any denial and provided with instructions on how to respond.

5.3 Right to an Accounting of Disclosures You have the right to receive a list of certain disclosures Find Recovery has made of your protected health information, excluding those made for treatment, payment, healthcare operations, or pursuant to your authorization.

5.4 Right to Request Restrictions You may request that Find Recovery limit how it uses or discloses your protected health information. Find Recovery will consider all requests, but is not required to agree to them. Agreed-upon restrictions will be honored except in emergencies.

5.5 Right to Request Confidential Communications You have the right to request that Find Recovery communicate with you in a specific way or at a specific location. All reasonable requests will be accommodated.

5.6 Right to File a Complaint If you believe your privacy rights have been violated, you may contact Find Recovery’s HIPAA Privacy Officer at the address above, or file a written complaint with the Department of Health and Human Services. You will not be penalized or retaliated against for filing a complaint.

5.7 Right to Receive a Copy of This Notice You have the right to obtain a printed or electronic copy of this Notice at any time.

6. Changes to This Notice

Find Recovery reserves the right to update the terms of this Notice at any time. Any revised Notice will apply to all protected health information Find Recovery maintains, including information received before the revision. The current Notice will always be available on our website and at our facilities, and will include the effective date of the most recent update.
